Terms of Service

These Terms of Service ("Terms") govern your use of mobile applications operated by Ginger Blue LLC ("we," "our," or "us") and distributed via the Apple App Store and Google Play Store (the "Apps"). By using the Apps, you agree to these Terms.

If you do not agree, do not use the Apps.

1. Eligibility

You must be at least 18 years old to use the Apps or have permission from a legal guardian.

2. Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate information

  • Maintain the security of your login credentials

  • Be responsible for all activity under your account

3. Subscription and Billing

a. Subscriptions

The Apps may offer paid subscriptions that renew automatically.

  • Billing is handled by Apple App Store or Google Play

  • Subscriptions renew unless canceled before the renewal date

  • You can manage or cancel subscriptions through your app store account settings

b. Refunds

All payments are handled by Apple or Google. Refund requests must be directed to the respective platform.

4. App Functionality

The Apps allow users to upload photos and generate Etsy listings using AI-assisted tools.

You acknowledge that:

  • AI-generated content may not always be accurate or compliant with marketplace rules

  • You are solely responsible for reviewing, editing, and approving listings before publishing

  • We do not guarantee listing performance, visibility, or sales outcomes

5. Etsy Integration

If you connect your Etsy account:

  • You authorize us to access and manage certain Etsy data

  • You remain responsible for compliance with Etsy’s Terms of Use and policies

  • We are not affiliated with, endorsed by, or responsible for Etsy

6. User Content

You retain ownership of the content you upload, including photos and listing data.

By using the Apps, you grant us a limited, non-exclusive license to:

  • Store, process, and display your content

  • Generate listings on your behalf

You represent that:

  • You own or have rights to all uploaded content

  • Your content does not infringe third-party rights

7. Commercial Use & Seller Responsibility

The Apps are intended for business and commercial use.

You are solely responsible for:

  • Accuracy and legality of listings

  • Compliance with Etsy policies, consumer protection laws, and advertising regulations

  • Customer interactions, fulfillment, returns, and disputes

We are not a marketplace and do not participate in transactions between you and your customers.

8. Acceptable Use

You agree not to:

  • Use the Apps for unlawful purposes

  • Upload illegal, infringing, or harmful content

  • Interfere with or disrupt the Apps

  • Reverse engineer or attempt to extract source code

9. Intellectual Property & DMCA

We respect intellectual property rights.

If you believe content within the Apps infringes your copyright, you may submit a notice including:

  • Your contact information

  • Description of the copyrighted work

  • Description of the infringing material

  • A statement of good faith belief

  • A statement under penalty of perjury

We may remove allegedly infringing content at our discretion.

10. Data and Privacy

Your use of the Apps is also governed by our Privacy Policy.

11. Service Availability (No SLA)

We strive to keep the Apps available, but we do not guarantee:

  • Continuous uptime

  • Error-free operation

  • Immediate access to services

We may modify, suspend, or discontinue features at any time without liability.

12. Account Termination

We may suspend or terminate your account if you violate these Terms.

You may stop using the Apps at any time and request account deletion.

13. Disclaimers

The Apps are provided "as is" and "as available" without warranties of any kind.

We disclaim all warranties, including:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

14. Limitation of Liability

To the fullest extent permitted by law, Ginger Blue LLC is not liable for:

  • Indirect, incidental, or consequential damages

  • Loss of profits, data, or business opportunities

15. Indemnification

You agree to indemnify and hold harmless Ginger Blue LLC from any claims arising from:

  • Your use of the Apps

  • Your content or Etsy listings

  • Your violation of these Terms

16. Arbitration & Dispute Resolution

Any disputes arising from these Terms will be resolved through binding arbitration in the State of New York, rather than in court, except where prohibited by law.

You agree:

  • To waive the right to a jury trial

  • Not to participate in class actions or class-wide arbitration

17. Changes to Terms

We may update these Terms from time to time. Continued use of the Apps means you accept the updated Terms.

18. Governing Law

These Terms are governed by the laws of the State of New York, United States.
